These Terms and Conditions (“Terms”) govern your use of the GlamRush2U Delivery Application (“GlamRush2U App”), platform, and affiliated content, which are copyrighted works belonging or licensed to GlamRush2U. The app enables individuals to sign up as delivery providers (“GlamRushers”) and provide services through the GlamRush2U Platform. Your provision of any delivery services is subject to your Independent Contractor Agreement or your employment agreement, as applicable.

By using the GlamRush2U App, you agree to these Terms and consent to the collection, use, and disclosure of your personal information in accordance with GlamRush2U’s Privacy Policies.

1. Definitions

1.1 The “GlamRush2U App” refers to the software provided by GlamRush2U, compatible with iOS and Android, including updates. It allows users to sign up as delivery providers and access tools and information for completing delivery orders.

1.2 The “GlamRush2U Platform” facilitates logistics and communication between consumers seeking beauty product deliveries and individuals or third-party providers fulfilling these services.

1.3 A “Device” is any mobile device capable of running the GlamRush2U App.

2. Proprietary Rights and Licenses

All intellectual property related to the GlamRush2U App belongs to GlamRush2U or its licensors. You may only use the App for authorized purposes. Reproduction, modification, distribution, or derivative works are prohibited.

GlamRush2U grants you a non-exclusive, non-transferable, non-sublicensable, revocable license to use the App on your device under these Terms. GlamRush2U may request feedback; all feedback becomes the exclusive property of GlamRush2U.

3. Conditions of Use

• You must be at least 18 years of age to use the App.
• You agree to provide accurate information and maintain confidentiality of your credentials.
• You will use the App only in compliance with laws, app store terms, and without unauthorized modifications or reverse engineering.
• Failure by GlamRush2U to enforce a provision does not waive its rights.

4. Disclaimer and Limitation of Liability

THE GLAMRUSH2U APP AND PLATFORM ARE PROVIDED “AS IS” AND “AS AVAILABLE.” GLAMRUSH2U DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND OPERATIONAL ACCURACY.

GlamRush2U is not liable for direct or indirect damages arising from app usage, including errors or service interruptions. GlamRush2U specifically disclaims liability for incidental, punitive, or consequential damages.

5. Changes and Updates

GlamRush2U may modify these Terms at its discretion, notifying users of significant changes. Continued use indicates acceptance. Users must keep the app updated; GlamRush2U is not responsible for issues arising from outdated versions.

• Device and Usage Data: IP, OS, app activity, frequency, and duration.
• Transaction Data: Order times, distance traveled, cancellations.
• Geolocation: For routing and delivery optimization.

c. Information Received from Third Parties

Includes background check data, partner feedback, retailer records, or law enforcement requests.

• Manage Relationships: Verify registration, assess eligibility, facilitate onboarding.
• Provide Services: Match delivery opportunities and optimize routes.
• Communicate Updates: Send notifications about services or policies.
• Marketing: Deliver personalized promotions and ads.

3. Information Disclosure

4. Biometric Information

We may collect biometric data (e.g., facial scans) for identity verification and fraud prevention. Retained up to 3 years post-deactivation, then permanently deleted.

5. Children’s Privacy

Only users aged 18 or older may use GlamRush2U. We do not knowingly collect data from minors.

Information retained up to 3 years for service or legal purposes. Biometric data follows specific retention rules.

• Update Account Info through the app.
• Request Account Deletion via “Delete Account” under profile.
• Deletion requests are processed within a few business days, after review and confirmation.
• Active orders must be completed before account deletion is permitted.
• A public URL allows deletion requests without app access.

10. Changes to this Privacy Policy

We may update this Policy to reflect operational or legal changes. Material updates will be communicated to users.

11. Non-Affiliated Sourced Retailers Disclaimer

GlamRush2U is not affiliated with or endorsed by selected retailers. We provide ordering and delivery services only and make no warranties regarding retailer products or brands.
