These Terms and Conditions (“Terms”) govern your use of the GlamRush2U Delivery Application (“GlamRush2U App”), platform, and affiliated content, which are copyrighted works belonging or licensed to GlamRush2U, developed to enable individuals to sign up as delivery providers (referred to herein as “GlamRushers”) and/or provide such services through the GlamRush2U Platform (as defined below). Your provision of any delivery services is subject to the Independent Contractor Agreement between you and GlamRush2U, including its subsidiaries or affiliates; or, if you’re providing services as part of employment, your delivery services are subject to your employment agreement or your employer’s agreement with GlamRush2U, including its subsidiaries or affiliates (each agreement may be referred to in these Terms as the “Agreement”).

Before using the GlamRush2U App, you must read, understand, and agree to these Terms. By using the GlamRush2U App, you agree to be bound by these Terms and consent to the collection, use, and disclosure of your personal information in accordance with GlamRush2U’s privacy policies.

  1. DEFINITIONS

1.1. The “GlamRush2U App” refers to the software provided by GlamRush2U, compatible with Apple iOS and Android operating systems, including updates. The app allows users to sign up as delivery providers and access necessary tools and information for completing delivery orders (“Services”) through the GlamRush2U Platform, pursuant to the Agreement.

1.2. The “GlamRush2U Platform” is the technology that facilitates logistics and communication between consumers seeking beauty product deliveries and individuals or third-party providers interested in fulfilling these services.

1.3. A “Device” is any mobile device capable of running the GlamRush2U App.

  1. PROPRIETARY RIGHTS AND LICENSES

2.1. All trademarks, copyrights, database rights, patents, and intellectual property related to the GlamRush2U App, including its underlying software code and any associated content, belong to GlamRush2U or its licensors and are protected by applicable laws. You may only use the GlamRush2U App for services specified under these Terms and the Agreement. You are prohibited from reproducing, modifying, distributing, or creating derivative works of the GlamRush2U App or its associated software.

2.2. GlamRush2U grants you a non-exclusive, non-transferable, non-sublicensable, revocable license to use the GlamRush2U App on your Device in accordance with these Terms and the Agreement. Licensing commences upon your acceptance of these Terms and will remain active until terminated by either party or upon the disposal of the GlamRush2U App.

2.3. GlamRush2U may request feedback related to the app or platform, including suggestions or images. All Feedback becomes the exclusive property of GlamRush2U. By providing Feedback, you waive any ownership rights and grant GlamRush2U full, perpetual, and transferable rights to use or modify your contributions for any purpose without compensation.

  1. CONDITIONS OF USE

3.1. To use the GlamRush2U App and provide services via the GlamRush2U Platform, you are required to create an account with accurate, complete, and truthful information. Account access details, such as login credentials, must remain confidential, and you accept responsibility for any actions taken under your account credentials.

3.2. You agree to only use the GlamRush2U App in the following ways:

  • According to the Agreement and the terms of service of the app store you downloaded it from (Apple App Store or Google Play);
  • Complying with relevant third-party agreements, laws, and regulations;
  • Only in locations where GlamRush2U services are available to customers;
  • Without renting, leasing, sublicensing, or redistributing the app to unauthorized parties;
  • Without using unauthorized modifications, exploits, or other activities to disrupt the GlamRush2U Platform;
  • Without attempting to reverse engineer, hack, or compromise GlamRush2U’s encryption, software, or operational systems.

3.3. GlamRush2U’s failure to monitor or enforce a provision of these Terms will not be considered a waiver of its rights to enforce it in the future.

  1. DISCLAIMER AND LIMITATION OF LIABILITY

4.1. THE GLAMRUSH2U APP AND PLATFORM ARE PROVIDED “AS IS” AND “AS AVAILABLE.” GLAMRUSH2U DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND OPERATIONAL ACCURACY.

4.2. GlamRush2U is not liable for any direct or indirect damages arising from app usage, including errors, interruptions, and delays in service. GlamRush2U specifically disclaims liability for incidental, punitive, or consequential damages and any costs incurred by third-party partnerships or store interactions occurring through the app.

  1. CHANGES AND UPDATES

5.1. GlamRush2U may modify these Terms at its discretion. Changes that are significant will be communicated (e.g., via email or app notification). Continued use of the GlamRush2U App after updates indicates your acceptance of revised Terms.

5.2. GlamRush2U may issue app updates to enhance functionality or safety. It is your responsibility to update the GlamRush2U App when new versions are available; GlamRush2U is not responsible for issues related to outdated software.

  • Contact Information: When you apply to become a GlamRusher or create an account, we collect your full name, email address, phone number, and home address.
  • Account Information: Includes username, password, profile photo, and other optional information you provide during registration.
  • Identification Information: To verify your identity, we may collect government-issued ID photos, driver license images, and Social Security or similar identification numbers.
  • Commercial Information: Details about your driver’s license, license plate number, vehicle make/model, insurance details, and other necessary registration data.
  • Financial Information: Bank account and routing numbers are collected to facilitate payments for services rendered.
  • Other Information: Includes data you provide when interacting with our support agents or responding to surveys.
  1. Information Collected by Automated Means

Certain information is collected automatically when you use or interact with the Services:

  • Device and Usage Data: Includes your IP address, browser type, operating system, and details on how you interact with the GlamRush2U app, such as frequency and duration of usage.
  • Transaction Data: Covers details of your service activities, such as time/dates of deliveries, accepted/canceled orders, and distances traveled.
  • Geolocation Information: Your location is tracked for purposes such as determining delivery zones, optimizing routes, and analyzing service patterns.
  • Cookies and Tracking Technologies: We use cookies, pixels, and similar tools to gather information about your activity across our apps and sites, improving user experience and for marketing activities.
  1. Information Received from Third Parties

We may also obtain information about you through partners, affiliates, or third-party services such as background check providers, customer contracts (e.g., ratings/feedback), retailers, or law enforcement when required.

The Personal Information collected is used to:

  • Manage Relationships: Verify registration details, assess eligibility, and facilitate your onboarding as a GlamRusher.
  • Provide Shopper Services: Match delivery opportunities, optimize routes, and predict delivery times based on your preferences and location.
  • Communicate Essential Information: Respond to inquiries, share updates, and send notifications regarding services or policy changes.
  • Marketing Activities: Deliver personalized promotions and advertisements based on browsing and service activities.
  • Fraud Prevention and Security: Detect and manage attempts at unauthorized access or fraudulent activity.
  • Improve Services: Analyze user behavior to enhance the overall experience and performance of the GlamRush2U platform.

Your data may also be combined with other sources to improve the quality of our services.

  1. Information Disclosure

Your Personal Information may be shared with:

  • GlamRush2U Affiliates: Shared among our affiliates for service and operational purposes.
  • Service Providers: Includes vendors for payment processing, background checks, or marketing activities.
  • Retail Partners and Customers: Relevant details (e.g., name, location, and ratings) may be displayed during active orders.
  • Legal or Government Requests: Disclosed in compliance with applicable laws or as required for investigations.

We may also disclose Personal Information in merger or acquisition deals or other significant business transactions.

  1. Biometric Information

GlamRush2U may collect biometric data, such as facial geometry scans, to prevent fraud and verify identity at onboarding and periodically thereafter. Biometric information will be retained for up to three years following deactivation, then permanently destroyed.

  1. Children’s Privacy

Only individuals aged 18 or older may use GlamRush2U services. We do not knowingly collect data from minors.

  1. Third-Party Websites and Services

Our Services may occasionally link to third-party sites. Their privacy policies govern how they handle your data and should be reviewed independently.

  1. Information Security

GlamRush2U uses reasonable administrative and technical safeguards to prevent unauthorized access or misuse of your Personal Information.

  1. Information Retention

We retain data as long as required to fulfill service goals or meet legal and regulatory requirements. Biometric data and certain other categories have specific retention periods, as described in this policy.

  1. Your Choices

You may opt to:

  • Update Account Information: Modify personal details or preferences via account settings.
  • Delete Personal Data: Submit deletion requests through your GlamRush2U account or by contacting us.
  • Control Marketing Preferences: Adjust or opt out of promotional communications.
  1. Changes to this Privacy Policy

GlamRush2U reserves the right to update this Privacy Policy to reflect operational changes or comply with law. The last revision date (April 1, 2025) appears at the top of this document. Material changes may be communicated directly to affected users.

  1. Consumer: User Account Deletion Process

To delete your account in our mobile application, please follow the steps below:

  1. Open the App: Launch the mobile application on your device.
  2. Access Account Settings: Tap on the profile icon, then go to Personal Data.
  3. Choose Delete Account: Scroll to the bottom and select Delete Account.
  4. Confirmation: A confirmation screen will appear. Please read the information carefully and confirm your decision.
  5. Account Deletion Complete: Once confirmed, your account and associated data will be permanently deleted in accordance with our data retention policy. This action cannot be undone.

Retailer Account Deletion Process (Web)

To request deletion of your account via the web application, please follow these steps:

  1. Open the App: Log in to your retailer account using a web browser.
  2. Navigate to Settings: Go to Settings.
  3. Go to Personal Section: Select the Personal tab.
  4. Click “Delete Account”: Click the Delete Account button to initiate the deletion request.

Important Conditions:

  • There must be no active orders linked to your store at the time of the request.
  • Once the request is submitted, your store will be marked as Inactive and will no longer be visible to customers.
  • The deletion request is forwarded to our Support Team for processing.
  • You have a 30-day grace period during which you can contact support to cancel the deletion request and restore your account.
  • After 30 days, your account and associated data will be permanently deleted and cannot be recovered.
